Por consiguiente, el adquirente resulta ser persona distinta de aquella que utiliz\u00f3 la edificaci\u00f3n durante el plazo de dos a\u00f1os desde que terminara su construcci\u00f3n o rehabilitaci\u00f3n por lo que la transmisi\u00f3n de dichos locales tiene la consideraci\u00f3n de segunda entrega a efectos de lo dispuesto en el art\u00edculo 20.Uno.22\u00ba de la Ley 37\/1992 y, en consecuencia, exenta del Impuesto sobre el Valor A\u00f1adido.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">No obstante lo anterior, si el traspaso hubiera sido consecuencia de la fusi\u00f3n, transformaci\u00f3n o escisi\u00f3n de la primitiva sociedad arrendataria, el tercero adquirente se subrogar\u00eda en la posici\u00f3n del arrendatario originario, siendo la entrega del correspondiente local comercial primera entrega a los efectos del IVA sujeta y no exenta del Impuesto.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Al resultar exenta la operaci\u00f3n de transmisi\u00f3n de los locales comerciales, podr\u00eda ser de aplicaci\u00f3n la renuncia a la exenci\u00f3n si se cumplen los requisitos legales.<\/p>\n<p style=\"text-align: justify;\">Si desea recibir m\u00e1s informaci\u00f3n no dude en contactar con nosotros en info@diligens.es<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/diligens.inconectawebs.com\/wp-content\/uploads\/2014\/09\/CV-1653-2014.pdf\">CV 1653 2014<\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>La consulta vinculante 1653\/2014 trata el caso de un local comercial que va a ser adquirido por terceros a quienes los arrendatarios primitivos les traspasaron, en virtud de escritura p\u00fablica, el local de negocio.
